1. About These Terms

These Terms of Service govern your use of apogeedetaj.us and any purchase from Apogée de Taj ("we", "us", "our"). By using our website or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy. You must be at least the age of majority where you live to place an order.

2. Orders

All orders are subject to availability and acceptance. Your order is accepted once we confirm it by email. We may decline or cancel an order, for example if a piece or material is unavailable, payment cannot be verified, or a product was listed with an incorrect price or description. If we cancel an order you have paid for, we will refund you in full.

3. Prices and Payment

All prices are in U.S. dollars. Prices may change without notice; the price you pay is the price shown when you place your order, as confirmed in your order confirmation email. Full payment is taken at checkout. Delivery is free on all orders. Unless shown at checkout, prices do not include customs duties or import charges, which are the customer's responsibility.

4. Ready-to-Wear Pieces

Every piece is made to order. Ready-to-wear pieces are made and dispatched within 1–3 weeks of your order. Because our pieces are handmade from natural fabrics, small variations in color, texture and finish are part of the craft, not defects. Colors may also look different depending on your screen.

5. Custom and Bespoke Pieces

Custom pieces take approximately 3–4 weeks to make, and bespoke pieces a minimum of one month, counted from confirmation of the final design, measurements and payment. Timelines may vary with design complexity and material availability. Changes requested after design approval or once production has started may incur additional charges and extend the completion date. If an agreed material becomes unavailable, we will contact you before substituting it.

6. Measurements and Fit

Please check our Size Guide before ordering. For custom and bespoke pieces, you are responsible for providing accurate measurements; we are not responsible for fit issues caused by inaccurate measurements or changes in your measurements after you submit them.

7. Design Discretion

Reference images you share are treated as inspiration unless an exact specification is agreed in writing. Minor differences between sketches, renderings and the finished garment may occur, and we may adjust construction where needed for fit, structure or wearability while keeping the approved design.

8. Rush Orders

If you need a piece sooner than our standard timeline, email us before ordering. Rush orders depend on availability and may carry an additional fee, which we will confirm with you in U.S. dollars before you order.

9. Cancellations

Ready-to-wear orders can be cancelled by email before production begins. Custom and bespoke orders use materials and labor allocated specifically to you; if you cancel, a charge of 30% to 100% of the order value may apply depending on the work already done. Orders already in production may not be eligible for cancellation.

10. Returns, Exchanges and Refunds

Returns and exchanges are accepted within 7 days of delivery for ready-to-wear pieces that are unworn, unwashed, and returned with tags attached in their original packaging. Custom, bespoke and made-to-measure pieces cannot be returned or exchanged. Full details are in our Refund Policy. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

11. Shipping and Delivery

Orders ship from our atelier in the Philippines. Delivery times are estimates, and we are not responsible for delays caused by carriers, customs or events outside our control. Once we hand your order to the carrier, ownership and risk of loss pass to you. See our Shipping Policy for details.

12. Our Designs and Content

All designs, photographs, text, logos and other content on this website belong to Apogée de Taj or its licensors. You may not copy, reproduce or use our designs, images or brand without written permission. Purchasing a garment does not transfer ownership of its design.

13. Use of Our Website

You agree not to use our website for any unlawful purpose, to copy or scrape content using automated tools, to interfere with its security or operation, or to provide false information. We may suspend access if these Terms are broken.

14. Relationship with Shopify

Apogée de Taj is powered by Shopify, which enables us to provide our services to you. However, any sales and purchases you make in our store are made directly with Apogée de Taj. By using our services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Apogée de Taj, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Apogée de Taj.

15. Events Outside Our Control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as natural disasters, severe weather, government restrictions, courier disruptions or supply shortages. We will tell you about any material delay and complete your order as soon as reasonably possible.

16. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim relating to an order will not exceed the amount you paid for that order, and we are not liable for indirect or consequential losses.

17. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without limiting any mandatory consumer rights you have under the laws of your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. The version in effect when your order is confirmed applies to that order.
